Terms of Service

1. Acceptance

By using this website or engaging Apex Trade Group LLC (“Pulsework AI”), you agree to these terms.

2. Services

We provide AI automation and AI agent design, build, and management services. The specific scope, deliverables, timeline, and fees for any engagement are defined in a separate written proposal or statement of work, which controls if it conflicts with these terms.

3. Fees & payment

Project fees are typically flat and billed 50% to start and 50% on launch unless otherwise agreed. Care plans are billed monthly in advance. Out-of-scope work is quoted separately via our change-request process.

4. Ownership

Upon full payment, you own the workflows, prompts, configurations, and documentation we build for you. You are responsible for third-party tool subscriptions and API costs in your own accounts. We retain ownership of our pre-existing methods, templates, and know-how.

5. Client responsibilities

You agree to provide timely access, accurate information, and necessary approvals. You are responsible for the lawful use of any automations and for compliance obligations specific to your business and data.

6. Third-party services & AI

Our solutions integrate third-party services (e.g., AI model providers, automation platforms) governed by their own terms. AI outputs can be imperfect; we design guardrails and human checkpoints, but you are responsible for reviewing outputs used in critical decisions.

7. Warranties & liability

Services are provided on a commercially reasonable basis. To the maximum extent permitted by law, our total liability is limited to the fees paid for the engagement giving rise to the claim. We are not liable for indirect or consequential damages.

8. Confidentiality

Each party will protect the other's confidential information and use it only to perform under the engagement.

9. Changes

We may update these terms; continued use constitutes acceptance.
